Terms of Service

Note: During the pre-launch Friends & Family phase, these Terms of Service may be updated before public launch. Users will be notified of material changes. We recommend reviewing this page regularly.

1. Acceptance of Terms

By accessing and using aiSmartBudget (the “Service”), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service. Skyline Revenue Solutions, LLC dba aiSmartBudget (“Company,” “we,” “us”) reserves the right to make changes to these terms at any time without notice.

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms of Service.

2. Description of Service

aiSmartBudget provides personal finance management tools powered by artificial intelligence. The Service allows users to connect their financial accounts, track spending, analyze financial patterns, and receive personalized insights to help manage their finances more effectively.

IMPORTANT: The Service is a tool for personal financial management and analysis only. We are NOT a licensed financial advisor, investment advisor, or financial professional. The Service does not provide financial advice, investment recommendations, or professional tax or legal guidance. Users are solely responsible for all financial decisions and should consult with qualified professionals before making any financial or investment decisions.

3. Eligibility

You represent and warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement. The Service is currently available only to residents of the United States. By using the Service, you represent that you are a US resident. We reserve the right to verify your eligibility at any time.

If you are under 18 or do not meet eligibility requirements, you may not create an account or use the Service.

4. Account Registration & Security

Registration

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during registration and to maintain and promptly update such information as necessary.

Account Credentials

You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree not to share your credentials with any third party. You are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Multi-Factor Authentication

Multi-Factor Authentication (MFA) is required for all aiSmartBudget user accounts. You agree to enable and maintain MFA to access the Service. Failure to maintain MFA may result in account suspension.

5. Connecting Financial Accounts

The Service integrates with the Plaid API to securely connect your financial accounts. By connecting an account:

• You authorize us to access your financial account data through Plaid
• You grant read-only access to transaction history, balances, and account information
• You acknowledge that we do not have direct access to your banking credentials
• You agree that Plaid handles all authentication securely on your behalf
• You may revoke access to any connected account at any time through your account settings

We are not responsible for any errors, outages, or delays in financial data caused by your financial institution or Plaid. The accuracy and timeliness of financial data depend on your financial institution's systems and the Plaid API.

You agree to review your financial data displayed in the Service and notify us immediately if you identify any discrepancies or unauthorized transactions.

6. Acceptable Use & Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Violating any applicable federal, state, or local laws or regulations
• Attempting to gain unauthorized access to the Service or our systems
• Reverse-engineering, decompiling, or attempting to discover the source code of the Service
• Transmitting malware, viruses, or any malicious code
• Using the Service to interfere with or disrupt the Service's operation
• Harassing, threatening, defaming, or abusing other users
• Scraping, automated access, or excessive data collection from the Service
• Impersonating another person or entity
• Using the Service for fraudulent or deceptive purposes

Violation of these terms may result in immediate account termination and legal action. We reserve the right to investigate and take appropriate legal action against any user who violates these terms.

7. Intellectual Property

All content, features, functionality, and materials provided through the Service, including but not limited to text, graphics, logos, images, algorithms, and software, are owned by Skyline Revenue Solutions, LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, modify, distribute, or transmit any content from the Service without our prior written permission. All rights not expressly granted herein are reserved.

aiSmartBudget, the aiSmartBudget logo, and all related names, marks, emblems, and images are trademarks of Skyline Revenue Solutions, LLC.

8. Disclaimer of Warranties

The Service is provided on an “as-is” and “as-available” basis. We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or meet your expectations. The accuracy, completeness, or timeliness of financial information provided through the Service is not guaranteed.

You understand and agree that we are not a licensed financial advisor, investment advisor, tax advisor, or legal professional. The Service provides informational tools only and does not constitute professional financial, investment, tax, or legal advice. You are solely responsible for all financial decisions and should consult with qualified professionals before taking any action based on information provided by the Service.

9. Limitation of Liability

In no event shall Skyline Revenue Solutions, LLC, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or damages for loss of profits, data, use, or goodwill, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to this agreement or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, if any.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Skyline Revenue Solutions, LLC and its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms of Service
• Your violation of any third-party rights
• Any financial decisions you make based on information from the Service

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, if:

• You breach any provision of these Terms of Service
• You engage in prohibited conduct
• We believe your account poses a security or fraud risk
• You are no longer eligible to use the Service
• We discontinue the Service or a feature you rely on

Upon termination, your right to access the Service will cease immediately. You may request deletion of your data subject to our privacy policy and legal obligations.

Sections that by their nature should survive termination shall survive, including but not limited to: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms shall be exclusively brought in the state or federal courts located in Oregon, and you irrevocably consent to the jurisdiction and venue of such courts.

You agree that any claim or cause of action arising out of these Terms of Service or the Service must be brought within one (1) year after the cause of action arises, or such claim or cause of action is forever waived.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the Service. We will notify users of material changes via email or prominent notice on the Service. Your continued use of the Service following notification constitutes your acceptance of the updated terms.
